ESS Technology, Inc. today announced that it has filed a lawsuit against Taiwanese chip designer MediaTek Inc. for recently discovered copyright infringement of ESS’s DVD firmware used with its Swan and Vibratto chips.
The suit, filed in the United States District Court for the Northern District of California, alleges that MediaTek intentionally and unlawfully used ESS’s copyrighted DVD firmware in MediaTek’s products.
The lawsuit seeks damages and requests that the court issue a preliminary and permanent injunction to stop MediaTek’s products and DVD players containing those products from being imported into the United States.
‘ESS Technology will take all steps necessary to protect the millions of dollars we have invested over the years in developing our proprietary software, firmware and high-performance integrated chips,’ said Robert Blair, president and CEO of ESS Technology. ‘We believe that our intellectual property has been a key part of our success in the marketplace, and we intend to protect this proprietary technology to the fullest extent of the law.’
